On the 10th January 1998 the Alliance Against the BNRR launched a major legal challenge against the mechanism in which the BNRR was given the go ahead.
This legal challenge is being carried forward by six individuals who have been long term members of the Alliance. To finance this legal action the Alliance has launched a community wide fundraising campaign to raise, in the first instance, £25 000. This money will cover the expected legal costs of the BNRR 6 in the event of them losing in the high court. The aim of this legal challenge is to make a public the documents of the concession agreement between the government and Midland Expressway Limited, the company who have won the concession to build and run the BNRR for 53 years.
John Prescott has indicated on several occasions that the compensation clauses within the concession agreement were substantial. The compensation clauses should have no bearing on whether the road is needed or not in transport terms.
